PARTICIPANT WAIVER OF LIABILITY AND HOLD HARMLESS AGREEMENT

I hereby make application for myself and my family members, including those who may be minors, and business/club/organization, to voluntarily participate in the Downtown Franklin Rotary Club (DFRC) Christmas Parade to take place on December 5, 2026, in Franklin, TN. I/we hereby certify that in the case of an accident, personal injury, or death, I/we will not hold DFRC or the city of Franklin, TN, their officers, members, agents, employees and volunteers responsible for any bodily injury, death or property damage and hereby release any officer, member, agent, contractor, employee or volunteer of the DFRC and the city of Franklin, TN, from any claim or claims that might arise as a result of bodily injury, death or property damage or as a result of participation in the parade. I/We further agree to use good safety precautions and abide by the rules of the parade, all ordinances and regulations of the City of Franklin and all State and Federal Laws, including obeying Tennessee’s Hands-Free Law. I/We affirm and understand that at no time will items (candy, trinkets, etc.) be thrown from any vehicle or float to any parade spectators. The DFRC reserves the right to remove any participant for failure to abide by the
requirements herein, any amendments hereof, Parade General Information and Rules (Attached).

The Undersigned expressly acknowledges that the activities of the parade (including pre-and post-parade activities) may be dangerous and may involve the risk of serious injury, death and/or property damage. The Undersigned agrees to indemnify, defend and hold harmless from any liability for the foregoing, the DFRC and the city of Franklin, TN, any officer, member, agent, contractor, employee or volunteer of the
DFRC and the city of Franklin, TN. This Waiver of Liability and Hold Harmless Agreement shall be governed by the laws of the State of Tennessee and jurisdiction shall be proper only in Williamson County, TN. The invalidity or unenforceability of any of the provisions hereof shall not affect the validity or enforceability of the remainder of this Agreement.

By signing below, the participant acknowledges that they have read and understand the waiver as described above and agrees to hold harmless the DFRC and the city of Franklin, TN, their officers, members, agents, employees and volunteers associated with the Downtown Franklin Rotary Club
Christmas Parade from any liability, including reasonable and necessary attorney fees. Participants in the DFRC Christmas Parade agree that all photographs, videos and like media images taken before, during and immediately after the DFRC Christmas Parade may be used in any and all social media publications and promotions of the DFRC. I/we also represent that I/we am/are authorized to sign this document on behalf of myself and family members, including minor children, business/club/organization, participants and anyone else taking part in the DFRC Christmas Parade as a participant of the undersigned.

THIS IS A RAIN OR SHINE EVENT. IN THE EVENT OF INCLEMENT WEATHER, PLEASE FOLLOW THE DFRC
EMERGENCY PLAN.
